Sales Terms

The following Terms and Conditions apply to all products sold by the Middle Park Conservation District. All buyers agree to these terms at the time of order placement.

Tree Seedlings & Perennials
Grass and Wildflower Seed
Tire Tanks for livestock and wildlife
Polyacrylamide (PAM) for sealing ditches and ponds

When purchasing tree seedlings, seed, ditch sealant, or tire tanks from MPCD,

ALL buyers agree to the following TERMS & CONDITIONS OF SALE

Tree Seedlings & Perennials

  1. Nursery stock is to be used for conservation purposes only (e.g. Reforesting burned areas, Enhancing wildlife habitat, Reducing soil erosion, Protecting water supplies, and Serving as living snow fences that provide protection from wind and snow.)
  2. Seedlings are sold in the quantities listed on this form; lots will not be broken to facilitate the sale of individual seedlings (except XLP trees).
  3. All orders are final; No cancellations or refunds.
    • In the event that trees orders are unavailable for delivery, a refund will be offered unless a substitute species can be arranged.
  4. THERE IS NO GUARANTEE OF SURVIVAL. Trees, shrubs, and perennials are living organisms that require proper care. Sometimes, even with diligent care, seedlings die.
    • Wind, water, sun, and shade; elevation, slope, and aspect; soil type, preparation, and compaction; grazing pressure, foot traffic, erosion, and herbicide use; seed or seedling type and quality; as well as planting depth and timing all play roles in the success of your planting
    • Increase your chances of survival by reading our Planting Instructions and checking out our Seedling Survival Supplies.
    •  Sometimes the nursery “trim back” deciduous plants and perennials before delivering them.  While this doesn’t always look pretty, it is meant to support the overall health and viability of the plants.

Grass and Wildflower Seed

  1. THERE IS NO GUARANTEE OF SUCCESS. So many factors play into the successful germination and survival of grass and wildflower seeds.
    • Wind, water, sun, and shade; elevation, slope, and aspect; soil type, preparation, and compaction; grazing pressure, foot traffic, erosion, and herbicide use; seed or seedling type and quality; as well as planting depth and timing all play roles in the success of your planting.
    • Successful grass seeding is more an art than a chance encounter. Seeding success often requires a healthy dose of persistence, patience, and perseverance.

  2.  All sales are final; No refunds.

Ditch and Pond Sealant

  1. THERE IS NO GUARANTEE OF SUCCESS. There is no miracle pond or ditch sealer that has 100% guarantee. Product application requires some patience. When applied as directed, it gives the pond and/or ditch owner a fighting chance against leaks that normally would not be fixed without reconstruction or expensive liners or pipes.
  2. All sales are final; No refunds.
  3. Depending on the size of the leak and the product purchased, it may take more than one application and/or reapplication to see results. 
  4. Products may degrade with time and exposure to sun.
  5. Products may require water and soil disturbance to properly bind with suspended sediment.

Tire Tanks

  1. TIRES ARE SOLD AS IS. There may be gashes and disfigurements on the outside of the tires, but the interior lining should be solid and unharmed.
  2. All sales are final; No refunds.
  3. It is up to the buyer to install the cut tire and make it into an operational livestock/wildlife watering tank. Tire tank design/assistance is available through our office (call 970-724-3456, ext 3 for NRCS).
  4. Buyer is responsible for determining if oversized load permits are required for tire pick up.
